LittleAsia.ch (“the Site/Website”) is owned and operated by Little Asia .
For these Terms and Conditions, wherever the context so requires, “You”, “Your” or “User” shall mean any natural person or legal person who has agreed to become a buyer on the Website. The term “We”, “Us”, “Our” shall mean Little Asia .
Your use of the Website and its services and tools are governed by the following “Terms and Conditions” as applicable to the Website, including the applicable policies which are incorporated herein by way of reference.
Accessing, browsing, or otherwise using the Site indicates Your agreement to all the terms and conditions, so please read them carefully before proceeding.
By impliedly or expressly accepting these Terms and Conditions, You also accept and agree to be bound by Little Asia’s policies (including but not limited to the Privacy Policy) as amended from time to time. If You transact on the Website, You shall be subject to the policies that apply to the Website for such transactions. By mere use of the Website, You shall be contracting with Little Asia, and these Terms and Conditions, including the policies, constitute Your binding obligations with Little Asia .
Eligibility
Services of the Site would be available to natural and legal customers with domicile in Switzerland at the sole discretion of Little Asia. Persons who are “incompetent to contract” including minors, un-discharged insolvents, etc. are not eligible to use the Site.
If you are a minor, i.e., under the age of 18 years, you shall not register as a User of the Little Asia website and shall not transact on or use the Site. If you are a minor, i.e., under the age of 18 years, you may and are willing to use or transact on the Site, such use or transaction may be made by your legal guardian or parents on the Site, and you shall be prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited.
Little Asia reserves the right to terminate your registration and/or refuse to provide you with access to the Site if it is brought to our notice or if it is discovered that you are under the age of 18 years.
Account & Registration Obligations
All users are suggested to register and log in for placing orders on the Site. You must keep your account and registration details current and correct for all communications related to your purchases from the Site.
By agreeing to the Terms and Conditions, the user agrees to receive promotional or transactional communication and newsletters from Little Asia and its partners. The user can opt out of such communication and/or newsletters by contacting customer services.
Product Images & Description
Product images that you see on our website are for representation only to enable you to get a fair idea about the products you want to order. The actual product may vary in terms of appearance, packaging, etc. The product images and descriptions provided on the website are on an “as is” basis and without warranties of any kind, expressed or implied.
All information is believed to be accurate but is not guaranteed and is subject to change. The product images, descriptions, and categories are provided solely for your information and convenience purposes, without any expressed or implied warranties or liability of Little Asia.
The image quality and colours of the products on the website depend on your monitor, and we cannot guarantee that your monitor’s display of any colours will be accurate.
Nutritional & Allergy Information
LittleAsia.ch distributes food and other products manufactured by third parties. Please refer to the product packaging for nutritional and allergy information. Although Little Asia believes it to be accurate at the time of publication, to the extent permitted by applicable law and except as otherwise set out in these Terms and Conditions, Little Asia accepts no responsibility for, and makes no representation or gives any warranty or undertaking, express or implied, as to the accuracy or completeness of the information.
You must use your judgement while consuming these products. Little Asia does not assume any liability for adverse reactions to the foods consumed.
We always try to make the ingredients and allergens for the product available online correctly and up to date. However, it can happen that manufacturers change their ingredients. There may be discrepancies between the information on the product packaging and the information in the product description in the online shop. Therefore, please always read the list of ingredients on the product packaging before consumption.
Pricing
We aim to ensure that the prices of all products offered for sale are true and correct. However, from time to time, the prices of certain products may not be current or may be inaccurate on account of technical issues, typographical errors, or incorrect product information provided to us by third-party sellers. In each such case, notwithstanding anything to the contrary, Little Asia reserves the right to cancel the order without any further liability.
Subject to the foregoing, the price mentioned at the time of ordering a product shall be the price charged at the time of delivery.
Prices are quoted by default in CHF. The shipping and packaging charges are calculated and shown separately from the quoted price.
Payment
We offer you multiple payment methods such as PayPal, MasterCard, Visa, PostFinance, and TWINT. Our trusted payment gateway partners keep your transaction details safe using secure encryption technology.
While availing of any of the payment methods available on the Website, we will not be responsible for or assume any liability whatsoever in respect of any loss or damage arising directly or indirectly to you due to:
- Lack of authorization for any transaction(s), or
- Exceeding the pre-set limit mutually agreed by You and between “Bank(s)”, or
- Any payment issues arising out of the transaction, or
- Decline of transaction for any other reason(s)
You, as a customer, can cancel your order anytime up to the cut-off time of the slot for which you have placed an order by sending an email to our customer service. In such a case, we will refund any payments already made by you for the order.
If we suspect any fraudulent transaction by any customer, or any transaction which violates the terms & conditions of using the Website, we, at our sole discretion, may cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and may deny access to them or cancel any orders placed by them.
Delivery
All deliveries made as per your orders placed shall be subject to delivery charges as decided by Little Asia. Little Asia reserves the right to change its Fee Policy from time to time. Any changes in the delivery charges shall be posted on our website. Delivery will be made to the address specified by you on the order form. You are responsible for ensuring that someone is present at the delivery address to receive the order. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive the same.
We will deliver your order to the main entrance of the delivery address. We always reserve the right to deliver only to the main entrance of the delivery address. We shall not be liable, directly or indirectly, for any special request by you to our delivery associate to deliver the order to any other place than the main entrance of the delivery address.
Refunds & Credit Note
The delivered products must be checked by the user immediately after acceptance for completeness, correctness, and any delivery damages.
Users have the right to claim a refund for a dry product within 7 calendar days of delivery. Once the claim has been accepted and approved by our customer service, the refund will be processed.
For registered users, the refund will be credited to your account on the Site. This can be used to pay for your subsequent purchases. It usually takes 5–7 working days for the credit to reflect in your account.
For guest users, the refund will be made in the form of a credit voucher with 12 months validity.
We take adequate measures to deliver Fresh and Frozen products; however, a lot depends on how you store and when you consume the products. Therefore, we are unable to accept any claim for refunds after 4 hours of delivery.
Trademark
All third-party trademarks (including logos and icons) referenced by LittleAsia.ch remain the property of their respective owners. Unless specifically identified as such, Little Asia’s use of third-party trademarks does not indicate any relationship, sponsorship, or endorsement between Little Asia and the owners of these trademarks. Any references by LittleAsia.ch to third-party trademarks are to identify the corresponding third-party goods and/or services and shall be considered nominative fair use under trademark law.
Governing Law and Jurisdiction
The relationship between LittleAsia.ch and its users is solely governed by Swiss law. The place of jurisdiction is Zurich.
Modification of Terms & Conditions of Service
Little Asia may at any time modify the Terms & Conditions of use of the Website without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on the Site. You should regularly review the Terms & Conditions on the Site. In the event the modified Terms & Conditions are not acceptable to you, you should discontinue using the Service. However, if you continue to use the Service, you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions.
